WESTERN-STYLE BATTLE: WYOMING VS. EPA VS. TRIBES


The dispute started in December when the EPA ruled on a request from the Northern Arapaho and Eastern Shoshone tribes, which sought "state status" in order to administer air quality monitoring. The EPA determined the land in question actually belongs to the Wind River Indian Reservation and has for more than a century, despite a 1905 law opening it to non-tribal members. The decision encompasses the city of Riverton. 

COMMENTS:
What a gut-wrenching battle this is for me.  I’m solidly behind the tribes getting some of their land back; I’ve been involved in Indian Country all of my life, and I feel it’s been an ongoing gross injustice that we whites have perpetrated against Native Americans.  On the other hand, I also have a background in the study of law.  Now, I’m not educated on the particulars of how the Northern Arapahos and the Eastern Shoshone ended up on the same reservation.  I do know that they own a lot of land in Wyoming.  I have to presume that they ended up there either because the government forced them there or because they agreed to some treaty.  In either event, the U.S. Congress had to be a party to the ultimate decision.  I firmly believe that the EPA lacks the official capacity to determine who the land belongs to, and that they should have their over-reaching ears pinned back.  The Wind River tribes, however, do have the standing to take the matter to Federal Court and on to the Supreme Court.  But, if you allow the EPA to make the decision, then why shouldn’t the Department of Education be able to rule that Manhattan also belongs to the Lenape American Indians?

A. That’s about the dumbest thing I’ve ever heard of.  Why doesn’t this country just roll over and play dead until the Chinese come to collect on their debt? 

Q. Now that Bloomberg is out of office, what’s going on with his organization, “Mayors Against Guns?”  (Rod ~ Lander, WY)
A. It’s Mayors Against Illegal Guns, and mayors are literally running away in droves.  They claim that they didn’t realize the organization wants to trash the Second Amendment and take away all of our gun rights.  They insist that they are against illegal guns, (who isn’t?), and that the organization morphed into a personal vendetta by Bloomberg and his hooligans against all guns.  Bloomberg has said now that he is out of office, he intends to take gun control head on until every last gun in the country has been melted down, and he doesn’t care whether you like it or not.  He stinks like hell and needs a GI shower. 

Q. I know all of the figures floating out of the Obama Administration are as worthless as teats on a boar but, do you have any idea how many people are really signing up for ObamaCare?  (Sonni ~ Vancouver, WA)
A. Whatever the truth is, only half of them have paid any premiums.  Now, we do know that they claim 6 million, but in that figure are the people who have not paid, the people who ended up on Medicaid instead, and the people who already had insurance and were forced onto ObamaCare for one reason for another.  My suspicions are that the number of actual new ObamaCare enrollees is less than 2 million, of which half have not paid.  Frankly, I am in total favor of people NOT signing up as a measure of their defiance of this purely rotten law, as long as they can find some other form of coverage or they can afford medical care themselves.  I have to add that caveat, because I don’t want to see anyone hurt financially in this battle, except ObamaCare itself.
